Terms and Conditions

1. Final Booking & Contract

A booking is considered binding once the initial retainer has been received. The issuance of the invoice and the subsequent receipt of the retainer secure the commission for both parties. By paying the retainer, you formally accept these Terms & Conditions, and a legally binding contract comes into effect. The payment of the retainer serves as a contractual signature.

2. Retainer & Payment Terms

A retainer of €2,000 is required to secure the final booking. The remaining balance will be invoiced after the wedding and is due within 7 days of receipt of the invoice. The retainer is a non-refundable fee. In the event of a cancellation, the retainer will be withheld. Should the wedding date change and the photographer/videographer be unable to attend the new date, the retainer will also be forfeited. If the payment is not received on time, the photographer/videographer is not obligated to perform the services.

3. Usage Rights & Intellectual Property

Copyright remains with "Filmtau – Sarah Pfister and Felix Lang." The client is granted private usage rights (publication and reproduction) for the delivered images and films. If the material is published online (e.g., Instagram, Facebook), a clear credit to the author is requested (e.g., "Film/Photo by Filmtau" or "© filmtau.com"). Any manipulation of the photos or videos, as well as their resale, is strictly prohibited. Participation in competitions requires the written consent of the author. Unless otherwise agreed, the works created may be included in our official portfolio and published for promotional and presentation purposes on our website and social media platforms. The couple must ensure that all guests and participants are informed and agree to be photographed and filmed. Any objections must be communicated prior to the wedding.

4. Cancellation & Extraordinary Circumstances

The contractor reserves the right to withdraw this offer prior to the final booking without providing reasons. The client has the right to cancel the contract up to one month before the wedding date. Cancellation must be submitted in writing. The following cancellation fees apply based on the time of receipt:

  • Up to 6 months before the date: The retainer is withheld.
  • Up to 3 months before the date: 50% of the total booked package price.
  • 1 month or less before the date: 75% of the total booked package price. Exceptions may be made in cases of documented illness (couple) or death (immediate family). Verification of the situation is at the discretion of the contractor. Claims for damages against the contractor are excluded unless caused by intentional misconduct. In the event that the contractor is unable to attend the agreed date due to extraordinary circumstances (e.g., sudden illness, accident, or force majeure), no liability is assumed for any resulting damages or losses.

5. Exclusive Right of Service

The photographer/videographer must be the only professional photo/video team on the wedding day. We are not responsible for compromised shots caused by external flash systems or interference from other photographers/videographers. During portrait sessions, we require exclusivity to ensure the artistic quality of the results. The contractor assumes no liability for the violation of rights of depicted persons or objects.

6. Limitation of Liability

In cases of simple negligence, liability for property or financial damage is excluded. If force majeure (e.g., accident, illness, flight cancellation, equipment failure) prevents the execution of the contract, the client waives claims for damages or the shifting of additional costs to the contractor. In such cases, the retainer will be refunded in full. If the wedding itself cannot take place due to force majeure, the contractor waives the claim for any agreed costs beyond work already performed.

7. Catering & Travel Costs

Meals, drinks, and seating for the team (1 or 2 persons, depending on the package) must be provided free of charge during the booking period.

Travel originates from Salzburg. To ensure a seamless and transparent experience, all travel and logistical costs are calculated individually for your specific celebration and are already included in your custom collection. This ensures there are no hidden fees or additional travel expenses after the wedding.

8. Creative Freedom & Revisions

The client acknowledges that all works are subject to the artistic discretion of the contractor. Complaints regarding artistic style, location choice, or technical means used are excluded. We strive to incorporate client wishes during editing where possible. Any requested revisions or changes to the delivered material are charged at €50 per hour. Such requests must be made within 14 days of delivery. Significant errors (e.g., technical glitches, missing sound, or misspelled names) will be corrected free of charge. Photo editing includes lighting, sharpness, composition, color grading, and RAW development. Advanced beauty retouching is not included. RAW files will not be released under any circumstances.

9. Working Hours

Working hours begin upon arrival and end after the agreed duration. Additional hours may be added prior to the wedding day or during the event itself.

10. Pandemic Regulations (COVID-19)

If a wedding must be canceled entirely due to government lockdowns, it will be treated as "Force Majeure." If the wedding remains possible under restrictions (e.g., reduced guest count or time limits), this is not considered a valid reason for cancellation. If the date is moved and the contractor is unavailable, the retainer will be withheld.

11. Copyright Law

The contractor holds the exclusive copyright to all photos and videos created. According to copyright law, these rights are non-transferable. The client acquires rights for non-commercial, personal use. Any commercial use requires written consent from the contractor.

12. Portfolio Usage & Privacy Options

Our studio’s growth and creative development rely on the ability to showcase our work. The collection prices listed in your proposal include a Portfolio Benefit, acknowledging your consent to allow Filmtau to use the captured material (photos and films) for our portfolio, including our website, social media, and industry exhibitions.

We deeply respect the need for privacy. Should you prefer that your wedding remains entirely private and opt-out of our portfolio usage, a 20% exclusivity surcharge will be added to the collection total. This adjustment reflects the standard rate of our services when the marketing value of the work cannot be utilized. By confirming your booking, you acknowledge that the offer price is contingent upon the portfolio usage agreement unless the exclusivity option is selected.

13. Acceptance of Terms

By booking a wedding package, the couple expressly agrees to these Terms & Conditions.

14. Final Provisions

For all points not regulated in these T&Cs, statutory legal regulations apply. Any amendments to the contract or these T&Cs must be made in writing.

These Terms & Conditions are effective as of January 1, 2026.
